TinyCue Terms of Use

These Terms of Use ("Terms") govern your use of TinyCue (the "App"), provided by an independent, individual developer ("we," "us," "our"). By downloading, installing, or using TinyCue, you agree to these Terms. If you don't agree, please don't use the App.

1. What TinyCue is

TinyCue is a habit-tracking app. Some habits can complete themselves when your iPhone can detect that you did them, using on-device motion data or Apple Health workouts you've recorded. TinyCue is a tool to help you track and build routines — see §6 below for what it is not.

2. Accounts

TinyCue has no account or sign-in of its own. Your data is tied to your device and, if enabled, your personal iCloud account, both of which remain under your control at all times.

3. TinyCue Plus (subscriptions)

TinyCue offers an optional auto-renewing subscription, "TinyCue Plus," that unlocks additional features.

  • Billing and renewal. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price shown in the App at the time of purchase.
  • Free trial, where offered, converts automatically into a paid subscription unless cancelled before the trial ends.
  • Managing or cancelling. Manage or cancel your subscription any time in your device's Settings → [your name] → Subscriptions, or via the "Manage Subscription" link in the App. Cancelling stops future renewals; it does not refund the current period.
  • Refunds are handled by Apple according to Apple's own policies — we do not process payments or refunds directly and cannot issue them ourselves.
  • Price changes will be communicated in advance as required by Apple's guidelines and applicable law before they take effect on your next renewal.

4. Acceptable use

You agree to use TinyCue only for its intended purpose and not to: reverse-engineer or tamper with the App beyond what's permitted by applicable law; interfere with the App's operation; or use the App in any way that violates applicable law.

5. Your content

Your habits, notes, and other data you enter remain yours. We claim no ownership over it. Since TinyCue stores your data locally (and, if enabled, in your own private iCloud), you're responsible for keeping your device and iCloud account secure.

6. Not medical or professional advice

TinyCue is a habit-tracking tool, not a medical device, and is not a treatment for any medical or mental-health condition, including ADHD. Automatic detection (from motion or Health data) is a convenience feature, not a clinically validated measurement — it can miss events or register them inaccurately, and Health data shown in the App reflects records that may have been entered or edited by other apps or by you directly in Health. Nothing in TinyCue constitutes medical advice, and TinyCue does not guarantee any particular health, behavioral, or productivity outcome from using it. If you have a medical concern, consult a qualified professional.

7. Disclaimer of warranties

TinyCue is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law. We do not warrant that the App will be uninterrupted, error-free, or that automatic detection will be accurate or complete.

8. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us, if any, in the 12 months before the claim arose.

9. Termination

You may stop using TinyCue at any time by deleting the App. We may suspend or discontinue any part of the App at our discretion, though we will make reasonable efforts to give notice of any change that meaningfully affects your access to features you've paid for.

10. Third-party terms

Your use of the App is also subject to Apple's standard End User License Agreement (found at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) where Apple's own terms apply, and Apple's Media Services Terms and Conditions govern your purchases through the App Store. Apple is not responsible for the App or its content, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

11. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll update the "Last updated" date above and note it in the App's release notes. Continued use of the App after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Thailand, without regard to its conflict-of-law principles, except where applicable consumer-protection law in your own country or region gives you additional rights that cannot be waived.
